CONTEST

Rules of participation

1.   The contests are held by Hamster, a division of Novexco Inc. (hereinafter: the "Contest Organizer"). They are held on the Internet and/or social media for a period of exactly 7 days (hereinafter: the "Contest Period").

2.   Contests for which registration is done exclusively on the Hamster website (hereinafter: "Web Contests") may be promoted and advertised on social networks, or any other place and platform deemed acceptable for advertising.

3.   Similarly, contests for which registration is done exclusively through interaction with the social media post (hereinafter: "social media contests") may be promoted and advertised on our website, or any other place and platform deemed acceptable for advertising. Online registration on our website will be disabled.

4.   Meta and all of its subsidiaries are, in no way, affiliated or attached to the contests held by Hamster on their platforms. Therefore, they are free from any legal and moral liability concerning these contests.  

ELIGIBILITY

1.   This contest is open to all residents of Canada who are 18 years of age or older. Employees, agents and representatives of the contest organizer, their affiliated, related, subsidiary and affiliated companies, their advertising and promotional agencies, partners, participating merchants, suppliers of prizes, materials and services related to this contest or any other party directly involved in the holding of this contest, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and all persons with whom these employees, agents and representatives reside, are excluded.

HOW TO PARTICIPATE - REGISTRATION

Web contest

1.   NO PURCHASE NECESSARY. Enter the contest by visiting hamster.ca/contest. Click on the icon with the contest title to enter. To participate:

Complete the electronic entry form. Be sure to include your exact contact information: last name, first name, address, phone number where you can be reached between 9:00 a.m. and 5:00 p.m. on weekdays. Click on the "Submit" icon to send your registration form before the contest period ends. Upon reception of your registration confirmation message, you will automatically be entered in the contest.

2.   Entrants must comply with the following limits ; failure to do so could result in the contest organizer cancelling one or more of their entries:

  • There is a limit of one entry per person during the contest period;
  • A person may not register more than once and the use of only one e-mail address per person is permitted, in the event that a person has more than one.
  • All entries from minors must be authorized by a parent


Social media contest

  1. NO PURCHASE NECESSARY. Enter the contest simply by interacting with the Facebook post (by clicking the "like" button or commenting) before the contest period ends. Under no circumstances will Hamster ask you to share the post or its Facebook page to enter any of its contests.
  2. Entrants must comply with the following limits ; failure to do so could result in the contest organizer cancelling one or more of their entries:
  • There is a limit of one entry per person for the duration of the contest. Clicking "like" and commenting will not result in an additional entry.
  • A person may not enter more than once and the use of one account per person is permitted, in the event that a person has more than one account.
  • Any participation of a minor must be authorized by a parent
     

PRIZE

1  The prize is offered to a predetermined number of winners, which will be clearly stated in the contest description. The winners will be randomly selected after the registration period is over :

Prize: A clear description of the prize and the approximate cumulative value of all prizes awarded in this contest will be stated in the contest description.

2.   The following conditions apply:

Non-exchangeable and non-transferable. Must be accepted as is. If the prize is not used, in whole or in part, no compensation will be provided. In the event that all or part of the prize is delivered by mail, the contest organizers are not responsible for late delivery, loss or theft of the prize, including, from time to time, in the course of delivery. Colors, models and brands may vary according to the supplier or the contest organizer. The participant must provide the necessary information and documentation for the delivery of the prize.

DRAWING

1  In the 48 hours following the end of the registration period, in Montreal, at Hamster, a division of Novexco Inc. (950 Place Paul-Kane, Laval, Qc, H7C 2T2), a random selection of the winners will be made from among all entrants registered in accordance with these rules in order to award the prizes. Prizes will be awarded to the first participants selected.

2  There is a limit of one prize per person per residence.

3.   Odds of being selected at random depend on the number of entries registered in accordance with these rules.

PRIZE CLAIM

1.   In order to be declared a winner, any selected entrant must:

        a)  Be reached by phone, for web contests, or by private message "Messenger" for social media contests, by the contest organizers within five (5) days of the random selection; and

        b)   Sign the declaration and release form (hereinafter the "Declaration Form") that will be sent to him/her and return it by email to the contest organizer no later than five (5) days following its reception;

        c)  Correctly answer the mathematical skill-testing question on the "Declaration Form"; and

        d)  Provide the information, authorizations, consents and other documentation necessary for the delivery of the prize to the premises in the form.

2  Failure to comply with any of the conditions stated in these rules will result in the selected entrant's entry being void and a new drawing for that prize will be conducted in accordance with these rules until an entrant is selected and declared a winner.

3  Within four (4) to six (6) weeks of receiving the completed and signed "Declaration Form", the Contest Organizers will inform any winner of the manner in which he/she may take possession of his/her prize. In the event that all or part of the prize is delivered by mail, the Contest Organizers are not responsible for any delays in delivery, loss or theft of the prize, including in the course of delivery.

GENERAL CONDITIONS

1.   Verification. Entries are subject to verification by the Contest Organizers. Any entry that is, as the case may be, incomplete, fraudulent, submitted late or does not contain the required clue or the correct answer to the question appearing on the entry form (if required in the context of the Contest) will be automatically rejected and will not entitle the entrant to a prize. Similarly, Facebook profiles and all information related to the profiles are subject to verification by the contest organizer for the sole purpose of confirming the legitimacy of the entries.

2.   Non-compliant entries. The Contest Organizers reserve the right to disqualify any person or to cancel one or more entries of any person participating in this Contest or attempting to participate in this Contest by a means that is contrary to the rules or that is unfair to the other participants (e.g.: entries exceeding the permitted limit, computer hacking, etc.). This person may be referred to the appropriate legal authorities.

3.   Acceptance of prize. All prizes must be accepted as described in these rules and cannot be transferred to another person, substituted for another prize or exchanged in whole or in part for cash, subject to the provisions of the paragraph dealing with prize substitution.

4.   Prize Substitution. In the event that, for reasons unrelated to a winner, the Contest Organizers are unable to award a prize (or a portion of a prize) as described in these Contest Rules, they reserve the right to award a prize (or portion of a prize) of the same nature and equivalent value or, at their sole discretion, the value of the prize (or portion of the prize) indicated in these Contest Rules in cash.

5.   Refusal to accept a prize. The refusal of a randomly selected person to accept a prize as provided in these Contest Rules releases the Contest Organizers from any obligation related to this prize towards this person.

6.   Limitation of liability - use of prize. Each selected entrant releases Hamster, their affiliates, related companies, divisions and subsidiaries, their advertising and promotional agencies, employees, agents and representatives (collectively, the "Releasees") from any and all liability for any damages that he or she may suffer as a result of accepting or using the prize. In order to be declared a winner and prior to receiving his/her prize, each selected entrant agrees to sign, if required, a "Declaration Form" to this effect.

7.   Warranty. Any person selected for a prize acknowledges that the only warranty applicable to his or her prize is the manufacturer's normal warranty. A statement to this effect will be included in the "Declaration Form".

8.   Prize Provider's Liability. Any person selected for a prize acknowledges that upon receipt of a letter confirming his/her prize, performance of the services related to that prize becomes the sole and exclusive responsibility of the prize provider. A statement to this effect will be included in the "Declaration Form".

9.   Limitation of Liability - Operation of the Contest. The "Releasees" release, to the fullest extent permitted by law, all liability for any computer component, software or communication line malfunctions, or for any transmissions that are faulty, incomplete, incomprehensible or erased by any computer or network, and which may limit or prevent any person from entering the Contest. The "Releasees" also disclaim any and all liability for any damage or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any web page, software or form and the transmission of any information for the purpose of entering the Contest.

10.   Modification. The Contest Organizer reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this Contest in whole or in part in the event of an event, error or human intervention that could corrupt or affect the administration, security, impartiality or conduct of the Contest as provided in these Contest Rules. In all cases, the Contest Organizers and their affiliated, related, subsidiary and affiliated companies, their advertising and promotional agencies, suppliers of products or services related to this Contest, as well as their employees, agents and representatives, shall not be required to award more prizes than those indicated in these Contest Rules or to award prizes otherwise than in accordance with these Contest Rules.

11.   Inability to Act - Labor Dispute. The "Releasees" will not be responsible or liable in any way for any inability to act due to any cause or circumstance beyond their control or due to a strike, lockout or other labor dispute at their place of business or at the places of business of any organization or firm used in the conduct of this Contest.

12.   Limitation of Liability - Participation. By entering or attempting to enter this Contest, each person releases, to the fullest extent permitted by law, the "Releasees" from any and all liability for any damages that he or she may suffer as a result of participating or attempting to participate in the Contest.

13.   Authorization. By entering this Contest, the winner authorizes the Contest Organizer, their partners and representatives and any person duly authorized by the Contest Organizer, to use, if required, his/her name, photograph, image, prize statement, place of residence, voice and any material submitted in connection with the Contest, without any form of compensation, at their discretion and without any limit as to the period of use, in any media and on a worldwide scale, for advertising or any other purpose deemed appropriate.

14.   Communication with Participants. No communication or correspondence will be exchanged with entrants in connection with this Contest except with those selected for a prize.

15.   Guest of a minor winner. In the event that the prize also extends to guests and a guest of a winner is a minor, the guardian or a person with parental authority will be required to sign the "Declaration Form" and accept, if applicable, the prize for and on behalf of the minor.

16.   Decisions of the Contest Organizer. All decisions of the Contest Organizer or their representatives regarding this Contest are final and without appeal, 

17.   Entrant Identification. For the purposes of these rules, the entrant is the person whose name appears on the entry form or Facebook profile and it is to this person that the prize will be awarded if selected and declared a winner.

18.   No Affiliation. This Contest is in no way affiliated with, endorsed, presented, sponsored or promoted by Facebook.

19.   Personal Information. Personal information collected on participants in connection with this Contest is used for the administration of this Contest and is subject to the Privacy Policy hamster.ca/statement-of-confidentiality. No communication, commercial or otherwise, unrelated to this Contest will be sent to the entrant by Hamster division of Novexco Inc. unless otherwise permitted by the entrant, if applicable, by checking the appropriate box on the official entry form or as permitted under the Privacy Policy.

20.   Language. In the event of any discrepancy between the English and French versions of these Rules, the French version shall prevail.
